IPA Files Appeal Challenging Gujarat High Court Order, Next Hearing on Jan 23

Indian Poker Association (IPA) has filed an appeal challenging the order passed by Justice R H Shukla earlier this month that categorized poker as a game of chance and deemed it to be “gambling and illegal”.

The appeal appeared before a division bench of the Gujarat High Court headed by the Chief Justice R Subhash Reddy yesterday where notices were issued to the state government and other respondents with the matter posted for hearing next on January 23. The appellants demand for stay on the single-judge bench`s order is also likely to be heard on this date.

Senior Advocate Subramonium Prasad along with local counsel Nachiket Dave appeared for the appellants.

According to a report published in the Times of India, one of the grounds for questioning the single-judge’s order was the judge`s reliance on ancient scriptures to term poker as gambling. The appeal read, “the judgment focuses on completely unfounded and unrelated principles, such as the Bhagavad Gita, to arrive at an erroneous conclusion that poker would constitute gambling.”

The appeal further went on to state, “on a perceived societal impact of gambling by bringing in comparison to sports betting, and then proceeding to discuss the evils of gambling as mentioned in the Rigveda and Manu, and completely ignoring the aspect of poker being a game involving a substantial degree of skill.”
